Legal marriage is a relatively new institution which was used in earlier times to control property rights for the monachy and the aristocracy. The peasants simply shacked up and no one minded.
The real argument is again about property and legal rights. Partners should be allowed to claim each other as next of kin, with all the rights that attach to that.
