Voting on this issue in California - How can minority rights be fairly decided by referendum of the majority?

The issue of gay marriage technically did go to vote already and it was a disaster. I think they are still in litigation about the wording and whether it caused unnecessary confusion amongst voters. I'm from California and I have to say I rue the day the Terminator came into office.
