NSW Adoption Bill passes

The Bill which gives same-sex couples in New South Wales the right to apply to adopt children has passed its final hurdle in Parliament and will now become law.

The Adoption Amendment (Same-Sex Couples) Bill, which was introduced by Sydney MP Clover Moore, narrowly passed in the Legislative Assembly this afternoon with a vote of 46 in favour and 43 against.

Then the Legislative Council approved the Bill to become law.

Previous heterosexual definitions of ‘de facto partner’, ‘couple’ and ‘spouse’ in the NSW Adoption Act, will now be amended to give all couples, regardless of their sexual orientation, the eligibility to adopt.

The Bill also amends stepparent adoption provisions that will allow for the legal recognition of same-sex step parents and long-term foster carers.

Amendments to the Bill in the last 24 hours ensure that relinquishing parents will have greater access to information on prospective adoptive parents and can express their wishes for the preferred background, beliefs and domestic relationship of these prospective adoptive parents.

The Bill had the support of the child welfare agencies the Benevolent Society and UnitingCare Burnside, while the Australian Christian Lobby, Anglicare and CatholicCare opposed it.

Adoption reform in NSW follows reforms in Western Australia and the ACT to permit same-sex couples the ability to adopt.

The NSW Gay and Lesbian Rights Lobby (GLRL) says tonight’s historic reform removes the last piece of direct legislative discrimination against same-sex couples in NSW.

“We are very pleased that NSW Parliament has acted in the best interests of children, ensuring all children are able to have two legally recognised parents, regardless of their family structure,” GLRL Convenor Kellie McDonald says.

GLRL Policy and Development Coordinator Senthorun Raj adds that “Same-sex couples, like all other prospective adoptive parents, will now be judged on their individual merits and their capacity to provide a loving and stable home for a child.”

But the GLRL is concerned about an Amendment to the passed Bill, which gives adoption agencies the opportunity to themselves decide that children they support not be given to same-sex couples.

“Publicly funded organisations providing adoption services should not be entitled to discriminate on the basis of a person’s sexual orientation or gender identity,” Raj points out.

I have only heard good things about Clover Moore's relationship with the gay community. She spoke at the same-sex marriage march I attended a year or two ago, and she wouldn't be where she is if she didn't support gay rights, I reckon.

I have problems with Clover, but for local government issues. As far as Gay issues are concerned, she's one of the communitys few active friends in the NSW Parliament. Some readers need to get in touch with reality on this one!
