Melbourne male sex workerarrested

A 36-year-old Melbourne sex worker was arrested yesterday as detectives investigate allegations that he has attempted to infect at least one male client with HIV.

The man, who had advertised his services in local gay publications, was apprehended in the north Melbourne suburb of Reservoir.

Police will charge him with attempting to intentionally infect another person with a serious disease, reports The Age today.

Actually if you report to the police in Victoria as having been a client of his you can be charged with using the services of an illegal establishment/non-compliant worker.

What fucking sickened me the most about this is that JOY94.9 was complicit in backing the police and further attacking the sex worker community within the LGBTIQ community.

The Sex Worker Act (1994) [VIC] states that a sex worker cannot work if they have been diagnosed with HIV, doing this makes the worker non-compliant.

Being a non-compliant sex worker merely means that the worker does not fall into the rigid three areas of what is considered by the legislation to be legal: Brothel, Agency and/or Private registered worker. To register as a private worker you have to give over your details to the Business Licensing Authority and you have no protection of privacy which is problematic considering the stigma and discrimination that sex workers face in our society.

I have been to saunas and other SOPVs over the years and have slept with more men than I can remember, for all I know I could have hooked up with heaps of guys who had HIV but I have always made sure we were safe and have never tested positive to anything. There is no law against this...HOWEVER...if any of those potentially HIV men received a payment in exchange for the sex then they can be imprisoned.

The only thing that makes this a criminal offence is the exchange of money between two consenting individuals of legal age (18 ). This section of the Sex Workers Act 1994 among many others needs to be overhauled and changed with the input of sex workers in government consultation.
